Terms & Conditions Long Distance
The purpose of this contract is to explain the terms and conditions under which Condor Moving Systems will furnish services to the owner or party entitled to represent the owner (known as the shipper or Customer) requiring the moving and/or storage of their property (known as the shipment). Upon the execution of this contract, the shipper hereby grants Condor Moving Systems any and all authority to act as the agent and with full power of the shipper, for the moving and storage of the shipment as outlined in this document. This document is to reflect the Terms and Conditions of Condor Moving Systems. All verbal agreements are null and void if not stated in writing on the Estimate of Charges (known as the contract) provided to you (the customer) by your Moving Consultant.
Condor Moving Systems, as the company in possession of the shipment shall not be liable the following:
A) Accounts, bills, deeds, evidence of debt, money, notes or securities, jewelry, watches, precious stones coins, stamp or other collections of any kind. These items should be moved by the shipper and not packed or moved by Condor Moving Systems.
B) Plants, perishable items, or animals. Condor Moving Systems will not accept or move these items.
C) Mechanical/Electrical Equipment: Condor Moving Systems is not liable for internal damage to any mechanical, electrical, electric electronic or digital equipment unless notation of external damage is made at the time of delivery.
D) Road Vibration.
E) Inherit Vice: Adjustment due to inherent nature of an item such as re-tuning a piano, re-setting/re-timing a clock, electronic calibration, and cleaning or maintenance, preexisting damage or other inherent vice.
F) Loss of income while item(s) being repaired or while lost items are being adjusted.
G) Acts of God, including, but not limited to humidity, lack of humidity, climate changes, rain, wind, flood, and hail and/or sun damage.
H) Pairs and Sets: Condor Moving Systems is liable for the value of only the item damaged or lost and not for the total loss or diminution of the pair or set.I) Property packed/unpacked by shipper.
1. SERVICES INCLUDED: The estimate includes limited furniture disassembly, pad wrapping, loading, unloading and reassembly. Only furniture pieces will be disassembled and reassembled. Work-out equipment, entertainment centers, surround sounds, computer equipment, playgrounds, outdoor playhouses and trampolines will not be disassembled or reassembled. Condor Moving Systems will not reassemble furniture that was not disassembled by our crew at origin. Baby cribs and bunk beds will be disassembled but will require a third-party services for reassembly. Condor Moving Systems will not disassemble or reassemble particle board furniture pieces and reserves the right to not disassemble or reassemble certain furniture pieces that may require extensive disassembly and reassembly. All appliances such as refrigerators, washer, dryers etc…must be made ready for shipping by customer third-party services are available upon request.

2. ESTIMATE: The estimate provided is strictly based on a physical survey if performed or based on the list of items and services provided by the shipper. Final charges are based on shipper’s actual inventory day of pick up is different than the items listed on this agreement. The shipper is responsible for providing Condor Moving Systems with an accurate and complete inventory list of all items to be moved. If a physical survey was not completed then customer has waived the need to perform a physical survey.
Dedicated Truck Note: Dedicated truck charges are based per specific unit being used; such unit cannot exceed Federal Motor Carrier Safety maximum weight requirements; nor exceed the use of 1 unit and 1 trip unless otherwise specified in the contract.
3. CUBIC FOOT CHARGES: The cost of moving any additional items or services performed will be in addition to this estimate at @@RatePer@@ cubic foot. The shipper will be financially responsible all charges. Minimum linehaul rate will be based on 200 cubic feet.
4. PACKING/UNPACKING: The shipper will be responsible for packing all items in boxes for safe transport unless the shipper has requested packing services. Packing charges are in addition to the standard line haul rates. On moving day the movers will have packing materials available to pack any items the shipper did not pack at an additional cost. Final packing charges will be determined the day of pick up by the job foreman. Condor Moving Systems is not responsible for items packed by the shipper. Items will not be moved if they are not packed properly. All items must be placed in boxes. All Fragile items such as mirrors, pictures, glass, marble tops and televisions must be boxed. Condor Moving Systems will not take responsibility for items not protected by the shipper or for items not properly packed. Unpacking charges apply if the shipper requests Condor Moving Systems to perform unpacking services. Condor Moving Systems will only unpack boxes and place contents on a flat surface, “counter tops or floor”. Items will not be placed in cabinets or closets. *PLEASE NOTE CUSTOMER WILL BE CHARGED FOR TAPE USED TO BLANKET PAD FURNITURE AT $3.50 PER ROLL
5. MATTRESS COVERS: Condor requires that mattresses are covered in heavy duty plastic bags or boxes due to sanitary and claims purposes. Condor will not accept mattresses that are not covered.
6. LONG CARRY: If items have to be carried over 150 feet from the truck to the front door at origin and/or destination, additional charges will apply.
7. STAIRS/STEPS: If items have to be carried over 14 steps at origin and/or destination, additional charges will apply. Additional charges may apply for interior stairs inside multi-family residence or a home exceeding two stories.
8. SHUTTLE: If there is no access for an 18-wheeler tractor-trailer at the delivery, and items have to be transferred onto a bobtail or smaller truck to make delivery, additional charges will apply. Shuttle charges are typical in downtown NY City, Manhattan, Boston, Washington, DC, San Francisco, Chicago, Boston, and Miami other urban areas or areas with road restrictions and are typically determined at the time of delivery. Shuttle charges are in addition to the estimate unless already included. Shuttle at billed at $0.75 per cubic foot with a minimum charge of $450.00, charges are based on shipment size.
9. PAYMENT TERMS: 20% non-refundable booking deposit due via Visa/Master Card/Discover, 40% due at the time of pick-up via: money order, cashiers check, Visa/Master Card/Discover a 3% convenience fee applies for all credit card transactions (40% of the grand total must be paid prior to shipment being placed in transit) and the remaining balance is due at delivery via postal money order only. CONDOR DOES NOT ACCEPT CASH PAYMENTS OR PERSONAL CHECKS.
Note:
1)Credit card payments may not be taken at the time of delivery.
2)If the shipper is not present at time of pick-up 50% of the estimated charges will be due will be due at the time of booking.
3)Delivery Payment must be made in full prior to driver unloading items at the time of delivery.
4)1.5% late fee per month will be applied to total if payment terms are not met; any free storage will be charged back to customer.
10. IMPORTANT: CUSTOMERS DECLARATION OF VALUE this is a tariff level of carrier liability – It is not insurance WARNING : If a moving company loses or damages your goods, there are 2 different standards for the company’s liability based on the types of rates you pay. BY FEDERAL LAW, THIS FORM MUST CONTAIN A FILLED-IN ESTIMATE OF THE COST OF A MOVE FOR WHICH THE MOVING COMPANY IS LIABLE FOR THE FULL (REPLACEMENT) VALUE OF YOUR GOODS in the event of loss, or damage to, the goods. This form may also contain an estimate of a move in which the moving company is liable for FAR LESS than the replacement value of your goods, typically at a lower cost to you. You will select the liability level later, on the bill of lading (contract) for your move. Before selecting a liability level, please read “Your Right and Responsibilities When You Move,” provided by moving company, and seek further information at the government website www.protectyourmove.gov
RELEASE VALUE: If any article is lost, destroyed or damaged while in your movers custody, your movers liability is limited to the actual weight of the lost, destroyed or damaged article multiplied by $0.60 per pound per article. Example: If you choose this option and your $2,000.00 sofa that weighs 200 pounds is lost or damaged during the move, the carrier’s maximum liability for said sofa would be $120.00. (200 pounds X .60 per pound = $120.00)
FULL VALUE REPLACEMENT COVERAGE: MUST BE PURCHASE THROUGH THIRD PARTY. This option allows you, the shipping customer, to declare the value of the items you are moving. The value declared would then become the carrier’s maximum liability in the event of loss or damage during your move.
STORAGE-IN-TRANSIT When storage-in-transit is provided, an additional valuation charge applies for the time your shipment is in storage.
EXTRAORDINARY VALUE Condor Moving Systems is permitted to limit its liability for loss or damage to articles that have an extraordinary value, unless you specifically provide Condor Moving Systems with a list of these articles. An article of extraordinary value is any item whose value exceeds $100 per pound.
SALVAGE If Condor Moving Systems replaces, makes a total loss payment, Condor Moving Systems has the right at its option, to salvage the damaged article. Condor Moving Systems also reserves the right to inspect and to verify the claimed damages on any item.
INSPECTION Condor Moving Systems reserves the right to inspect and verify all reported damages and to require substantiation of any claims amounts, value of items claimed, or proof of ownership. You may also be required to obtain a repair estimate from a local furniture repair firm. All electronics claims must include model, make, and serial number. Condor Moving Systems will not cover the expense of having furniture inspected.
POLICE REPORT For any lost items of high value Condor Moving Systems may require customer to file a police report with local authorities. Condor Moving Systems will cooperate with local authorities with all investigations of missing articles.
EXCLUSIONS UNDER THIS CONTRACT
- Loss or damage arising out of the acts of any government, customs authority or official confiscation.
- Consequential losses due to delay or any depreciation in value are not covered.
- Items missing from owner-packed cartons or containers. Claims will not be honored for the loss of any owner-packed carton or container unless the shortage has been noted at the time of delivery.
- Damage to articles not packed by the Condor Moving Systems unless there are physical signs of damage to the carton and these are damages noted on the mover’s paperwork at the time of delivery.
- Loss or damage to jewelry, gem stones, cash, currency or bank notes, deeds, travelers cheques, coin or stamp collections, alcoholic beverages, negotiable items, firearms and ammunition or contraband. These items should be transported by the customer.
- Loss or damage caused by wear and tear, changes in climatic conditions, infestations or inherit vice.
- Any internal electrical or mechanical component of any device. Loss of data and recalibration are also excluded. Plasma and high definition are specifically excluded from coverage.
- Loss or damage to vehicles and motorcycles.
- Wrinkled or soiled clothing, linens, drapes and rugs.
- Marring, scratching, denting, chipping or rubbing on items which have been received by the carrier as condition unknown.
- Non-delivery of an item if the delivery receipt/inventory shows that all items were delivered to the final destination.
- Items not listed on the inventory prepared at origin.
- Appraisal fees, shipping charges, items having no commercial value (i.e.: items of sentimental value).
- Acts of terrorism or war or domestic conflict.
- Loss caused by nuclear reaction, radiation or radioactive contamination, whether controlled or uncontrolled.
- Physical loss or damage to the property carried out for political, terrorist or ideological.
- Loss or damage to any items, unless loss or damage is noted on mover’s Bill of Lading and inventory, with the exception of concealed damage to items packed by Condor Moving Systems.
- Delicate and fragile items, including, but not limited to: glass tables, marble tables, slates, paintings, framed pictures, chandeliers, display cases, when not professionally packed and or crated in wooden or other protective containers. Wrapping items in moving pads does not constitute professional packing.
- Loss or damage to articles prepared for moving by the customer but not professionally wrapped with special moving pads, bubble wrap, and/or shrink wrap.
- Real estate or property damage.
- Liability for any items constructed of veneered chipboard, particle board, pressed wood, composite board or similar kind. Any reduction in the quality arising as the result or disassembly or reassembly of any such item is also excluded.
GENERAL NOTES
- Valuation must be purchased prior to packing or loading day.
- Valuation cannot be canceled or modified once the moving process (packing or loading) has begun.
- Payment for valuation must be made in full and collected by movers on the day of loading or packing whichever is first.
- Customer is responsible to check inventory and note loss/damaged items in the exceptions/remarks space on the inventory sheets provided at the time of delivery.
- Condor Moving Systems will not be liable for any loss/damaged to items not noted on the inventory at the time of delivery.
- Valuation is a contractual limit of liability as provided for in the section 14706, title 49, United States Code, and is not to be construed as insurance.
11. RESCHEDULING: Condor Moving Systems reserves the right to reschedule pick-up or delivery dates due to bad weather or force majeure.
12. PICK UP/DELIVERY TIME: Pick-up and delivery times are not guaranteed.
13. TRANSIT TIME: 1-10 business days from the first date the shipper can receive delivery; with the exception of Northern CA (San Francisco North), WA, OR, ID, MT, WY, ND, SD, MN, WI, MI, Upstate NY, VT, NH, RI, MA and ME which 1-21 business days.
Payment requirements and complete destination address must be provided before transit time starts.
Condor Moving Systems strives to ensure that all shipments are delivered within the estimated transit time. In the unfortunate event that the day of delivery exceeds the transit time Condor Moving Systems will reimburse the customer $15.00 per day.
Condor offers dedicated truck service and guaranteed delivery dates at an additional cost.
14. STORAGE/HOLDING FEES: If the shipper does not provide a delivery address at the time of loading, the shipper will be charged a holding fee from the time the shipment was picked up until the time the shipper notifies Condor that the delivery location is ready.
IMPORTANT INFORMATION ABOUT STORAGE CHARGES:
Storage/Holding Fee charges are billed monthly and due on the 1st day of each month.
Storage billing cycle starts on the 1st of each month and ends on the last day of each month. Storage charges are $0.50 per cubic foot per month. Only the first month is pro-rated for any remaining days for that given month. After the first month storage charges are only billed monthly regardless of the number of days you remain in storage.
Late Fees While In Storage: If storage payments are not received by the 5th a $25.00 late fee will be applied. If items are held in storage for over 90 days with no storage payment received items will be sold at public auction pursuant to Federal and State Laws. If items are in transit and the shipper advises Condor Moving Systems that the customer is not able to accept or pay for the delivery; the shipment will be placed in storage. The shipper will be charged for storage and redelivery.
15. FUEL SURCHARGE: A fuel surcharge will be added to your final line haul charges rate varies based on fuel prices between 10% to 20%.
16. CUSTOMER SERVICE ISSUES: If your move is in progress and the crew is performing outside the guidelines of your contract please contact MON-FRI 8:30AM to 5:30PM CST or our 24-Hour answering service at Toll-Free: 877-460-6683. Our goal is to ensure that we meet your expectations and would like to address any issues at the time of service so we are able to make immediate corrections if needed. All customer service concerns must be reported within 72 hours of incident.
17. PIANOS/POOL TABLES/CUSTOM BICYCLES: Condor can only move pianos from ground floor to ground floor; will not be responsible for retuning. Pool Tables – Condor can only disassemble pool tables; Condor cannot reassemble due to the leveling equipment required to set them back up. Custom Bicycles – customer will be responsible to disassemble and reassemble custom bikes for safe transport.
18. WALK-THROUGH: It is the customer’s responsibility to perform a walk-through with the foreman at the origin to ensure all items were loaded and to ensure that no items were loaded that were not intended to be loaded. If Condor is required to come back out for any items left behind additional charges will apply. At the time of delivery customer is required to ensure all disassembled items are properly reassembled prior to the driver leaving. Customer will be responsible for checking off inventory at the time of delivery to ensure all items were received. Customer acknowledges that customer must note lost or missing or damaged items at delivery.
19. ATTIC/BASEMENT: For insurance and liability reasons Condor Moving Systems will not pick up or deliver items into an attic/basement. It will be the customer’s responsibility to move those items in or out of their attic/basement.
20. HOISTING FURNITURE: Condor Moving Systems will not hoist furniture. 21. DOCUMENTS INCLUDED: The Federal Motor Carrier Safety Administration “FMSCA” publishes its Rules and Regulations, as well as the following documents: Your signing of this estimate constitutes your agreement that you have seen, reviewed and understand the documents located at the following links.

22. ARBITRATION: Condor Moving Systems participates in the United States Movers Association’s program for arbitration of disputes regarding household goods moves. 23. PROPERTY DAMAGE: If property damage occurs during your move it must be noted on the Order for Service or Bill of Lading and shown to the job foreman prior to the movers leaving your home or Condor will assume no liability.

25. LEGAL VENUE: In case of a dispute or claim, customer must make a written claim within 9 months of the date of delivery, or for lost or missing items, 9 months from the date the lost or missing items should have been delivered. Condor and customer hereby expressly agree that any lawsuits arising from the move shall be filed in the appropriate federal or state courts in Tarrant County, Texas.
26. GRATUITY: Although gratuity is customary, it is never mandatory. Please keep in mind the crew at the origin is typically different than the crew at destination.
27. DEBRIS REMOVAL: Condor Moving Systems will not perform debris removal or trash disposal.28. PRESSED WOOD: Condor Moving Systems will accept pressed wood furniture items at the risk of the shipper only. Pressed wood items will not be disassembled or reassembled unless it is at the risk of the shipper.
29. DO NOT SHIP (NON-ALLOWABLES): Condor Moving Systems is dedicated to safe moving. Hazardous items that pose a potential threat to the safety and health of our crews should not be packed into your shipment. 30. This estimate is good for 30 days; price is subject to change.
